Biosecurity Directive Defence – Fact Sheet
Responding to a Section 237 Direction Under the Biosecurity Act 2014 (Qld) for residential property address : ( put your address here )
1. No Biosecurity Matter Present
A thorough inspection of the property reveals no biosecurity matter as defined under the Act.
No evidence has been provided by authorities to substantiate the presence of biosecurity risks.
Without verified biosecurity matter, the directive lacks legal foundation under Section 237(1)(b).
2. Reasonable Excuse for Non-Compliance
The directive was issued without consultation or evidence disclosure.
Measures demanded exceed what is “reasonably necessary” under Section 237(2).
The burden imposed is unjustified and disproportionate given the lack of verified risk.
3. No Legal Requirement for Exclusive Chemical Use
The Act does not mandate the use of specific chemical products for compliance.
Section 237 allows for reasonable steps but does not prescribe exclusive methods.
Imposing chemical use without statutory authority may constitute regulatory overreach.
4. Request for Review and Clarification is being sought . It was submitted on / / .
I currently await the relevant authorized decision makers response to my request made to the Dept .
FYI, the request letter is seeking;
Evidence supporting the directive.
A review of the directive’s necessity and proportionality is sought.
Confirmation is requested that alternative, non-chemical compliance options are valid.
While my dispute is in progress , as freeze on the treating the property applies. I hereby respectfully instruct the team to leave my property, and not return , until such time my disputed matter with Program managers has been resolved.
